cre84.me Terms of Service

Effective date: [DATE]
Last updated: [DATE]

These Terms of Service (“Terms”) govern the website at cre84.me and the hosting and related services provided by [FULL LEGAL BUSINESS NAME], doing business as cre84.me, with a business address at [BUSINESS ADDRESS, USA] (“cre84.me,” “we,” “us,” or “our”).

“You” means the individual or organization purchasing or using our services (“Services”). By accepting these Terms during registration or ordering, you enter into this agreement. If you act for an organization, you represent that you have authority to bind it.

Your order identifies the Services, pricing, billing period, and applicable plan limits.

Any service-specific agreement, Acceptable Use Policy, or service-level agreement expressly identified and made available when you order is incorporated into these Terms. Our Privacy Policy at [PRIVACY POLICY URL] explains how we handle personal information.

A separately signed agreement controls over conflicting provisions of these Terms. Service-specific terms control for the particular service they address.

2. Eligibility and Account Information

You must be at least 18 years old and legally capable of entering into this agreement.

You must provide accurate account and billing information and keep it current. Maintain a working contact email address independent of a domain hosted with us.

You are responsible for authorizing account users, protecting credentials, and promptly reporting suspected unauthorized access. You must cooperate with reasonable account verification requests submitted through secure channels.

3. Service Scope and Support

We provide the Services described in your order. Unless expressly included, Services do not include website development, custom programming, application maintenance, malware cleanup, or management of third-party software.

Support is available through [SUPPORT CHANNELS AND HOURS]. Any response-time or resolution-time commitment applies only if expressly included in your plan.

You are responsible for checking that your applications and websites meet the published technical requirements.

4. Customer Content

You retain ownership of the files, websites, databases, messages, and other material you or your authorized users submit to the Services (“Customer Content”).

You grant us permission to store, copy, transmit, display as directed by you, and otherwise process Customer Content only as reasonably necessary to provide, secure, support, and maintain the Services or comply with law. This permission includes using infrastructure providers acting on our behalf.

You represent that you have the rights and permissions needed to upload and use Customer Content. You are responsible for your websites, transactions, end users, and compliance with applicable law.

5. Acceptable Use

You must not use the Services to:

  • Commit fraud, distribute malware, conduct phishing, or facilitate unlawful activity.
  • Access systems without authorization, disrupt networks, or conduct denial-of-service attacks.
  • Send unlawful unsolicited messages or operate services that facilitate abusive messaging.
  • Infringe intellectual property, privacy, or other legal rights.
  • Host or distribute child sexual abuse material or facilitate sexual exploitation.
  • Make unlawful threats or engage in unlawful harassment.
  • Circumvent security controls or exceed plan limits in a way that harms service availability.

You must comply with the Acceptable Use Policy at [AUP URL]. We may investigate credible abuse reports and restrict activity reasonably necessary to protect customers, infrastructure, or third parties.

6. Security and Software Maintenance

You are responsible for maintaining your applications, plugins, themes, access permissions, and credentials unless your plan expressly assigns a task to us.

We maintain safeguards appropriate to our role as a hosting provider. No system is completely secure.

We may perform security monitoring and access account information when reasonably necessary for support, security, abuse investigation, or legal compliance, consistent with our Privacy Policy and applicable law.

Notify us promptly at [SECURITY CONTACT] if you suspect a security incident affecting the Services.

7. Resource Limits

Your plan’s published limits govern storage, bandwidth, CPU, memory, email, processes, databases, and other resources.

“Unlimited” or “unmetered,” if offered, does not eliminate other disclosed technical limits or permit activity that materially interferes with other customers.

If your use exceeds plan limits, we may request corrective action or offer an upgrade. We may temporarily restrict activity where necessary to prevent material disruption. We will not impose undisclosed overage charges.

8. Fees, Currency, and Taxes

Prices are stated in U.S. dollars unless your order specifies otherwise.

You agree to pay the fees and applicable taxes disclosed before purchase. You are not responsible for taxes assessed on our net income.

Promotional prices apply only for the disclosed promotional period. Renewal prices and any setup or additional fees will be identified before you order.

Payments are due on the date shown on your invoice. Late-payment grace periods and any lawful late fees are: [INSERT POLICY].

9. Automatic Renewal

If you expressly enroll in automatic renewal, your subscription renews for the billing period disclosed at checkout, and you authorize recurring charges to your selected payment method until cancellation.

Before enrollment, we will disclose the recurring price, billing frequency, promotional terms, and cancellation method and obtain your consent as required by law.

You may stop renewal through [DIRECT ONLINE CANCELLATION METHOD]. If you cannot access that method, contact [BILLING CONTACT] for assistance.

Cancellation stops future subscription renewals. It does not automatically refund a charge already properly incurred. Any legally required renewal reminders, notices, consent procedures, or cancellation rights remain applicable.

10. Price Changes

We may change prices for future service periods by giving at least [NOTICE PERIOD] advance notice, or longer where required by law.

Price changes will not affect an already prepaid period unless you request a change to your Services. You may cancel renewal before a new price takes effect.

11. Cancellation and Refunds

You may request cancellation through [CANCELLATION METHOD], choosing immediate cancellation or cancellation at the end of the paid term where available. We will confirm the request and its effective date.

Hosting refund policy: [INSERT GUARANTEE PERIOD, ELIGIBLE SERVICES, REQUEST DEADLINE, EXCLUSIONS, AND REFUND PROCESS—OR STATE THAT NO VOLUNTARY MONEY-BACK GUARANTEE IS OFFERED.]

Refunds outside that policy: [INSERT POLICY FOR UNUSED PREPAID SERVICE.]

Domain registrations, renewals, certificates, licenses, setup work, and other third-party purchases are refundable only as disclosed before purchase or required by law.

Refund restrictions do not override rights required by applicable law. Contact [BILLING CONTACT] about billing errors. Nothing in these Terms limits lawful payment-dispute rights.

12. Domain Names

If we provide domain services, the registrar agreement and applicable registry policies disclosed during ordering also apply.

You are responsible for accurate registrant information and timely renewal instructions. We will provide notices required of us by applicable rules.

Any automatic domain-renewal charge date, cancellation deadline, expiration consequences, and restoration fees will be disclosed in the domain order or applicable domain agreement.

Canceling hosting does not automatically cancel domain registration or domain renewal. Domain ownership and transfer rights remain subject to applicable registrar and registry rules.

13. Backups and Data Recovery

Included backup service: [STATE FREQUENCY, RETENTION, COVERAGE, RESTORE FEES, AND LIMITATIONS, OR STATE THAT BACKUPS ARE NOT INCLUDED.]

You should maintain independent, current backups outside your hosting account and test that they can be restored.

Backup and recovery services are subject to their disclosed scope and limitations. Nothing in this section excuses us from an express backup obligation or liability that applicable law does not permit us to exclude.

14. Website Migration

Any migration assistance is subject to the scope and fees agreed before work begins. Migration success depends on source access, platform compatibility, and the condition of the source data.

Keep independent backups and retain your previous hosting until you have checked the migrated website, email, and databases. Migration completion dates are estimates unless expressly guaranteed in writing.

15. Availability and Maintenance

We may perform maintenance and updates needed to operate and secure the Services. Where practical, we will provide advance notice of maintenance expected to materially interrupt service.

Service-level agreement: [INSERT SLA URL OR STATE THAT NO CONTRACTUAL UPTIME GUARANTEE IS OFFERED.]

Any uptime commitment, measurement method, exclusions, credit amount, and claim deadline must be specified in that agreement.

16. Third-Party Services

Domains, control panels, payment tools, software, and other third-party products may have separate terms and licenses disclosed to you.

You must comply with applicable license restrictions. Purchasing hosting does not grant ownership of third-party software.

Our use of vendors does not eliminate obligations we expressly undertake in this agreement.

17. Resellers

If your plan permits resale, you are responsible for your customer relationships, billing, first-line support, and ensuring that your customers comply with applicable service restrictions.

You must obtain the rights and permissions needed for us to host their content. You must not make service promises on our behalf without written authorization.

18. Privacy and Hosting Locations

Our Privacy Policy describes our handling of account and service information.

Primary hosting locations: [ACTUAL COUNTRIES OR REGIONS].

A U.S. business address does not establish where every server, backup, or service provider is located. Any contractual data-location commitment must appear in your order or a separate agreement.

Where we process personal information on your behalf and applicable law requires additional processing terms, the parties must enter into an appropriate data processing agreement.

Do not submit information requiring a special contractual or technical arrangement, including protected health information subject to HIPAA, unless we have expressly agreed to support that use and executed any required agreement.

Copyright complaints should be directed to:

Designated agent: [NAME OR TITLE]
Address: [ADDRESS]
Email: [EMAIL]
Telephone: [NUMBER]

A DMCA notice must include the elements required by 17 U.S.C. § 512(c)(3), including identification of the copyrighted work and allegedly infringing material, sufficient location information, contact details, the required statements, and a signature.

A customer who believes material was removed by mistake or misidentification may submit a counter-notification satisfying 17 U.S.C. § 512(g)(3). We will process notices and counter-notifications under applicable law.

We maintain a policy for terminating, in appropriate circumstances, accounts of repeat infringers and accommodate applicable standard technical measures.

You must comply with laws applicable to your use of the Services, including applicable U.S. export controls and economic sanctions.

You may not use or receive Services where prohibited by law. Restrictions will be determined under current applicable laws and authorizations.

We may respond to legally valid government requests and preserve or disclose information as required or permitted by law, consistent with our Privacy Policy.

21. Suspension and Termination

We may suspend or terminate affected Services for material breach, nonpayment, unlawful activity, or a material security or operational threat.

Where practical and appropriate, we will give notice and a reasonable opportunity to correct the issue. Immediate action may be necessary for urgent threats, legal requirements, or serious abuse.

If we discontinue a prepaid Service for our convenience, we will refund the unused prepaid portion. Other refund consequences are governed by Section 11 and applicable law.

Post-termination data retention and export period: [INSERT ACTUAL POLICY].

After the stated retention period, Customer Content may be permanently deleted, subject to legal obligations. Export your data before cancellation or termination whenever possible.

22. Our Intellectual Property

We and our licensors retain rights in our branding, website materials, software, and service systems.

You receive permission to use those materials only as necessary to use the Services and as allowed by the relevant license. You may not copy, sell, or misuse them beyond that permission or rights granted by law.

23. Warranty Disclaimer

TO THE EXTENT PERMITTED BY LAW, AND EXCEPT FOR EXPRESS COMMITMENTS IN THIS AGREEMENT, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not promise uninterrupted or error-free service. This section does not exclude warranties or remedies that cannot lawfully be excluded.

24. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE TO THE OTHER FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THIS AGREEMENT.

OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE FEES YOU PAID US FOR THE AFFECTED SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to fraud, willful misconduct, gross negligence, or liability that applicable law does not permit to be limited. They do not eliminate refunds or credits expressly owed under this agreement.

25. Third-Party Claims

To the extent permitted by law, you will defend and indemnify us against third-party claims arising from your unlawful use of the Services, infringement by Customer Content, or material breach of these Terms.

This obligation does not apply to claims caused by our own breach, negligence, or willful misconduct.

We will promptly notify you of a covered claim, provide reasonable cooperation at your expense, and allow you to control its defense using reasonably acceptable counsel. You may not agree to a settlement imposing obligations or admissions on us without our written consent.

26. Governing Law and Disputes

These Terms are governed by the laws of [U.S. STATE], together with applicable federal law, without applying conflict-of-law rules.

Subject to mandatory consumer protections and any right to bring a claim in another legally required forum, disputes will be heard in the state or federal courts located in [COUNTY, STATE], as applicable.

Either party may contact the other to seek an informal resolution before filing a claim. Doing so does not restrict access to urgent relief or extend a legal deadline unless agreed in writing.

27. Changes to These Terms

We may update these Terms prospectively. For material changes, we will provide at least [NOTICE PERIOD] advance notice by email or another reasonable direct method, unless a shorter period is necessary to comply with law or address an urgent security issue.

The notice will identify when the changes take effect. Where affirmative consent is required, we will obtain it. Changes will not retroactively alter accrued claims or charges.

You may cancel before a change takes effect. Refunds remain governed by the applicable refund policy and law.

28. General Provisions

These Terms, your order, and applicable incorporated agreements form the entire agreement concerning the Services.

If a provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a provision on one occasion does not waive future enforcement.

Neither party is responsible for delays caused by events beyond its reasonable control, except that this does not automatically eliminate payment obligations or expressly promised refunds.

We may assign this agreement in connection with a merger, reorganization, or sale of the relevant business, subject to applicable law and without reducing existing customer rights. You may transfer your account only with our written approval, which we will not unreasonably withhold.

Provisions that reasonably need to survive termination—including accrued payments, ownership, liability limits, and dispute provisions—will survive.
